Bank of America Forecloses on House That Couple Had Paid Cash For


SPRING HILL — Charlie and Maria Cardoso are among the millions of Americans who have experienced the misery and embarrassment that come with home foreclosure.
Just one problem: The Massachusetts couple paid for their future retirement home in Spring Hill with cash in 2005, five years before agents for Bank of America seized the house, removed belongings and changed the locks on the doors, according to a lawsuit the couple have filed in federal court.
Early last month, Charlie Cardoso had to drive to Florida to get his home back, the complaint filed in Massachusetts on Jan. 20 states.
The bank had an incorrect address on foreclosure documents — the house it meant to seize is across the street and about 10 doors down — but the Cardosos and a Realtor employed by Bank of America were unable to convince the company that it had the wrong house, the suit states.
"Their own real estate agent told them, and nevertheless Bank of America steamrolled right ahead," said Joseph deMello, an attorney in Taunton, Mass., who is representing the couple. "This is a nightmare for anyone, and it affected my hard-working clients a lot."

  1. Seems like it doesn't pay to have anything; someone wants to steal it..this happened in other areas too, with massive foreclosures. These banks involved should be made to pay big bucks for this theft!

  2. If I was on the jury Bank of America would lose alot of money. And I would also make them pay for public message to apologize and make sure that it does not happen again.

  3. Absolutely unbelievable. And BofA could care less about these people. This is a criminal act, its called "grand theft". Why in the hell aren't someone or some people from BofA and their associated criminal companies sitting in jail right now? If you are I were to do this to a home, what would happen to us? We would be in jail.

    I hope BofA ends up paying millions and somebody in the local DA's office has the balls to press charges, Grand Theft Charges, against these criminals.

  4. People who still keep their money in Bank of America after reading this story and all the fraud that's taken place in banking in general are INSANE.

    No wonder America is falling apart.

  5. The wheels of justice grind along slowly. At some point criminal charges will be issued with warrants of arrest for those at fault. Later, much later, the civil lawsuit will unwind through federal court. In the end the bank at fault will compensate the home owners financial loss and pay punitive damages. The settlement will be agreed upon outside the courtroom. It will, however, take time.

    What citizens sould be quite frightened of is a systemic collapse in which the entire system is dysfunctional and you have no recourse for injutice.

    A collapse of the county, state, or federal government will not result in an explosion of freedom. It will result in an explosion of violence such as the likes of Croatia, Bosnia, the African continent, South America, and the Middle East nations have experienced in the past.

  9. Yep. I agree. The average juror in this lawsuit will crush BofA. They deserve it. Wish I was one of them. I think they will settle out of court if the bank is smart. It doesnt sound like they are smart so who knows.

    Anywase , Bank of Aholes , should be prosecuted and the couple warranted large amounts of worthless $$ , The thing that gets me really roaring is the fact that they just cannot simply appologize and settel this out of court , but noooooo they always have to be self righteous and always be the moral hazard , America will crumble only a matter of time .
