A Tucson, Ariz., SWAT team defends shooting an Iraq War veteran 60 times during a drug raid, although it declines to say whether it found any drugs in the house and has had to retract its claim that the veteran shot first.
And the Pima County sheriff scolded the media for "questioning the legality" of the shooting.
Jose Guerena, 26, died the morning of May 5. He was asleep in his Tucson home after working a night shift at the Asarco copper mine when his wife, Vanessa, saw the armed SWAT team outside her youngest son's bedroom window.
"She saw a man pointing at her with a gun," said Reyna Ortiz, 29, a relative who is caring for Vanessa and her children. Ortiz said Vanessa Guerena yelled, "Don't shoot! I have a baby!"
Vanessa Guerena thought the gunman might be part of a home invasion -- especially because two members of her sister-in-law's family, Cynthia and Manny Orozco, were killed last year in their Tucson home, her lawyer, Chris Scileppi, said. She shouted for her husband in the next room, and he woke up and told his wife to hide in the closet with the child, Joel, 4.
Guerena grabbed his assault rifle and was pointing it at the SWAT team, which was trying to serve a narcotics search warrant as part of a multi-house drug crackdown, when the team broke down the door. At first the Pima County Sheriff's Office said that Guerena fired first, but on Wednesday officials backtracked and said he had not. "The safety was on and he could not fire," according to the sheriff's statement.
SWAT team members fired 71 times and hit Guerena 60 times, police said.

Mike Storie, a lawyer for the SWAT team, said at a press conference Thursday that weapons and body armor were found in the home as well as a photo of Jesus Malverde, who Storie called a "patron saint drug runner," according to KGUN.

As for a legal warrant to search his house, well it appears to have been be a “fishing expedition” a suspicion type warrant to search MULTIPLE houses, a block or street ,who knows?

An investigation will no doubt be held to reassure Americans that the killing was legaly justified and the SWAT team acted according to current standards of best practices for open ended MULTIPLE warrent door kicking home invasions in minority areas in AmeriKa .
The media likes to throw around the word "assault rifle" a lot. When it's they talk about the identical SWAT teams guns, it's called a rifle or an m-4 or m-16.

I have to wonder if incidents such as these are caused by the lowered standards to become a police officer these days. You used to have to be a high school graduate and some college was preferred. Now you don't even have to be a HS graduate and the mental test is geared lower than 12th grade level so poorly educated minorities will not be discriminated against. Sadly, that hurts the whole force in my opinion.

ReplyDeleteThese cops were told before hand that this would be a high risk warrant service and no doubt they were scared. The moment one of these cops saw the home owner pointing an AR-15 at them, he instantly fired and all the others fired as a reflex action.
As I see it, the home owner did nothing wrong and the cops overreacted.
I am a former cop. I say the cops phucked up big time.
They should have known the "suspect" had a graveyard shift job and was a day sleeper. They should have known if the "suspect" had a dog in the back yard. If no dog, they could have quietly surrounded the house, with their cars down the street and had a "Delivery Service" van and driver (cop) go to the door and ring the bell. The "suspect's" wife would have answered the door and would then be told by the "Delivery Driver" that her husband would need to personally sign for a package. She would have called him to the door and he would have been arrested without incident.
This Pima County Sheriff's office is in deep caca. It will not go well for them, especially if this guy was totally innocent and not part of a home invasion crew.
